<p dir="ltr">Bilaspur gets court orders first</p>
<p dir="ltr">It was past noon when the order landed. Justice P.P. Sahu of the Chhattisgarh High Court granted a significant relief to suspended IAS officer Anil Tuteja in the alleged Jharkhand liquor scam. The court approved his anticipatory bail application, but the relief comes with a string of conditions that keep the probe agency in a position of strength.</p>
<p dir="ltr">Conditions that matter</p>
<p dir="ltr">The court was clear. Tuteja will have to furnish a personal bond of ₹50,000 and two solvent sureties of the same amount. But the more critical part is what he has to do after stepping out. The judge directed him to cooperate fully with the investigation. Any attempt to influence witnesses or tamper with evidence could be costly. The High Court explicitly said the agency can move an application to cancel his bail if he creates any hurdles.</p>
<p dir="ltr">Why the court leaned in his favour</p>
<p dir="ltr">Sources familiar with the matter said the court noted a few key gaps in the prosecution’s case. Tuteja has been in judicial custody for nearly two years in a separate money laundering case linked to the DMF scam. Yet, for this fresh FIR related to the Jharkhand excise policy, the Economic Offences Wing (EOW) hadn’t even sought his production for questioning.</p>
<p dir="ltr">“When the accused is already in judicial custody, why didn’t the agency approach the trial court for permission to interrogate or arrest him?” the High Court reportedly observed.</p>
<p dir="ltr">The bench also pointed out that the Jharkhand Police, which registered a separate FIR in the same matter, has not named Tuteja as an accused. A few other accused in that state have already secured bail.</p>
<p dir="ltr">The allegations in brief</p>
<p dir="ltr">The EOW had booked Tuteja under the Prevention of Corruption Act and IPC sections for criminal conspiracy and cheating. The charge is that Tuteja and others created a syndicate to run illegal liquor operations in Jharkhand. Investigators claim they replicated the Chhattisgarh excise model to tweak Jharkhand’s policy. The alleged result: favoured contractors got undue benefits, and the syndicate pocketed crores in unlawful commission.</p>
<p dir="ltr">The ‘evergreen arrest’ argument</p>
<p dir="ltr">Tuteja’s counsel argued that this was a classic case of what they called an “evergreen arrest.” The petition stated that whenever he appeared close to getting bail in one case, a new FIR would be filed to keep him behind bars. Over the last five years, five different agencies conducted searches but found no disproportionate assets, the lawyer submitted. The counsel also said there is no digital evidence, call record, or financial trail linking Tuteja to Jharkhand officials.</p>
<p dir="ltr">State’s counter and what happens now</p>
<p dir="ltr">The state government opposed the bail, calling Tuteja the mastermind behind multiple scams—from rice milling and coal to liquor. Their argument was that meetings held in Raipur hatched the conspiracy, causing huge losses to the Jharkhand exchequer.</p>
<p dir="ltr">For now, Tuteja has a legal window to step out. But officials say the bail conditions are tight. If the EOW moves court alleging non-cooperation, the relief could be short-lived. The next few weeks will show if the agency calls him for questioning or lets the matter rest.</p>
