The Bhopal Municipal Corporation’s drive against commercial activities operating from residential properties was put on hold on September 3, after 190 establishments had been sealed over the previous three days. The pause came as senior state and civic officials focused on preparing their response for the Supreme Court, which is scheduled to hear the matter again on September 15.

The sealing drive has triggered protests from traders and objections from residents, bringing the long-running dispute over commercial use of residential properties, enforcement and Bhopal’s urban planning framework back into focus.

190 Establishments Sealed in Three Days

According to the figures cited by the civic authorities, BMC teams sealed or closed action against 109 establishments on August 31, followed by 61 on September 1 and 20 on September 2.

This took the reported total to 190 establishments in three days.

No sealing operation was carried out on September 3. Officials said municipal teams were engaged with other legal and administrative work, including matters before the High Court.

Recent reporting also said BMC had compiled records of 8,264 notices, sealing actions, voluntary closures and geo-tagged photographs for its submission ahead of the Supreme Court hearing. 

Residents Raise Questions Over Selective Action

Residents who have approached the Supreme Court have raised concerns over the manner in which the enforcement drive is being implemented.

Petitioner Vivek Tripathi said residents had earlier complained about alleged unauthorised commercial establishments, including large malls in Arera Colony, but claimed that similar action had not been taken against them while smaller traders were being targeted.

The residents have submitted documents before the court and sought scrutiny of the enforcement process. These claims represent the petitioners’ position and have not been established as findings by the court.

The issue has added to traders’ concerns, with business associations arguing that a blanket enforcement approach could affect a large number of establishments operating in areas where commercial activity has continued for years.

Senior Officials in Delhi for Supreme Court Case

The September 15 hearing is now a key point in the dispute. Senior officials from Madhya Pradesh’s urban administration and BMC travelled to Delhi as preparations intensified.

According to recent reports, Additional Chief Secretary (Urban Administration) Sanjay Dubey and BMC Commissioner Sanskriti Jain met Solicitor General Tushar Mehta in Delhi regarding the matter. BMC officials were also compiling records of the action taken so far. 

The Supreme Court had earlier taken strong exception to the state government's decision to halt the sealing drive after it constituted a 10-member committee to examine the issue. The court kept that administrative order in abeyance and fixed the next hearing for September 15. 

Traders Continue to Seek Relief

The sealing campaign has prompted sustained protests from traders in several parts of Bhopal.

Business representatives have sought a policy that recognises mixed land use and have also renewed the demand for implementation of the long-pending Bhopal Master Plan. Traders argue that businesses have operated from several residential areas for years and that an abrupt closure could affect livelihoods and the wider local economy.

The issue is particularly significant because the civic body has identified a much larger pool of properties where commercial activity is allegedly taking place in residential areas. Recent reporting put the number of identified properties at more than 62,000, although the number subject to actual enforcement is a separate matter. 

Kailash Vijayvargiya Says Master Plan Decision Soon

Madhya Pradesh Urban Development and Housing Minister Kailash Vijayvargiya has said the government is examining legal options while remaining bound by the Supreme Court’s directions.

He has also indicated that the Bhopal Master Plan is being discussed and that a decision on it is expected soon.

The government’s position is that any solution must comply with the Supreme Court’s directions while also attempting to prevent unnecessary losses to traders and residents.

CM Mohan Yadav Seeks Long-Term Solution

Chief Minister Mohan Yadav has said the government is taking the concerns of both traders and residents seriously and will place its position before the Supreme Court.

Yadav has described the issue as a longstanding problem requiring a permanent solution rather than a temporary arrangement. The government has indicated that it will examine the interests of local residents and businesses while following the court’s directions.

The dispute now moves towards the September 15 hearing, when the Supreme Court is expected to consider the action taken by the civic authorities and the government’s response.

For Bhopal, the larger question extends beyond the current sealing drive: how the city should regulate commercial activity in established residential neighbourhoods while addressing planning gaps and protecting lawful interests without weakening enforcement of land-use rules.
