The legal team representing Giribala Singh, one of the accused in the high-profile Twisha Sharma death case, has publicly responded for the first time, asserting that the accused never refused to provide voice samples to the Central Bureau of Investigation (CBI).

Speaking to the media in Bhopal, advocate Enosh George Carlo said the defence had consistently cooperated with the investigation and that there was "no objection then or now" to furnishing voice samples. He maintained that the court's official order sheet should be treated as the authoritative record of what transpired during the proceedings.

Legal Concerns Over Transcript

Carlo clarified that the defence's concerns were not about providing voice samples but about the transcript supplied by the CBI for the recording process.

According to him, the accused sought legal clarification regarding the document before reading it aloud, arguing that every accused person has the right to consult legal counsel before participating in such procedures.

He further claimed that Giribala Singh had, in fact, spent nearly three hours providing voice samples during the investigation.

Consent Communicated to CBI

The defence lawyer stated that on July 11, they had formally informed the CBI that their clients had no objection to reading the transcript and providing voice samples.

"We have nothing to hide, and therefore there is no reason to fear. Our clients have cooperated with the investigation at every stage," Carlo said.

Court Recorded No Objection

Referring to the latest court proceedings conducted via video conferencing, Carlo said the judge directly asked both accused whether they had any objection to providing voice samples.

According to the defence, both Giribala Singh and co-accused Samarth Singh clearly stated that they had no objection and were willing to read whatever transcript was provided by the investigating agency.

Carlo claimed that the court's order sheet also records this statement.

No Need for Further CBI Application

The advocate argued that once the accused expressed their willingness before the court, there was no necessity for the CBI to pursue its application under Section 349 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

He said the court observed that an earlier order had already addressed the issue, making further proceedings on the application unnecessary.

Reference to Supreme Court Guidelines

Carlo also referred to the Supreme Court's 2016 judgment in Sudhir Kumar vs State (NCT of Delhi), stating that voice sample collection should strictly follow prescribed legal procedures.

He argued that voice samples should correspond to the original recordings intended for forensic comparison and that investigating agencies are responsible for addressing any legitimate legal concerns regarding the transcript before the process is carried out.

The case relates to the suspicious death of actress and model Twisha Sharma, who had married Samarth Singh on December 9, 2025. The investigation is currently being conducted by the CBI, with voice sample collection forming part of the ongoing probe.
