The ‘Reservation Hatao Andolan’ has moved from a contentious street demonstration to talks with the government. Union minister and senior BJP leader JP Nadda met three people associated with the campaign—Harsh Dubey, Ran Bahadur Singh Chauhan and Mrityunjay Pathak—on August 27.

Nadda described the interaction as cordial and said another meeting would be held soon. However, he did not announce acceptance of any demand, promise a review of caste-based reservation or indicate that the government’s existing policy would change.

Why Did the Meeting Trigger a Dispute?

The controversy is not merely about what was discussed. It is also about who had the authority to speak for the agitation.

Not every group or public figure associated with the August 21 mobilisation accepts the three-member delegation as the movement’s authorised representative body.

YouTuber Ajeet Bharti, who addressed the Jantar Mantar gathering, questioned Harsh Dubey’s role and warned the government against holding separate discussions with individuals without addressing the campaign’s collective demands.

According to an India Today report, Bharti claimed that a section of protesters had already rejected Dubey after his earlier meeting with Uttar Pradesh Deputy Chief Minister Brajesh Pathak. This remains a claim from within the movement; no commonly accepted process for selecting an official delegation has been made public. India Today report

The dispute reveals a central weakness of social-media-driven mobilisations: a campaign can assemble a large crowd without necessarily having a formal organisation, membership structure or recognised leadership.

What Did Nadda Actually Say?

Nadda said he held a pre-scheduled and cordial discussion with Dubey, Chauhan and Pathak following the Jantar Mantar agitation. He added that they would meet again.

That is the full extent of the publicly confirmed outcome.

There is no government statement confirming that:

• Caste-based reservation will be replaced by economic criteria.
• A creamy-layer rule will be extended to Scheduled Castes and Scheduled Tribes.
• The SC/ST (Prevention of Atrocities) Act will be repealed.
• Existing reservation percentages will be changed.
• A commission or committee will be constituted.

Until a written announcement emerges, describing the meeting as the government “accepting” the movement’s demands would be inaccurate.

What Does the Movement Want?

The demand most consistently raised during the August 21 demonstration was that economic hardship, rather than caste alone, should determine eligibility for reservation and other government assistance.

Protesters argued that scholarships, fee waivers, coaching assistance and educational support should reach poor families across communities.

However, speakers and participating organisations also raised several other demands:

• A government white paper examining the outcome of reservation policies.
• Sub-classification or a “quota within quota” for the most disadvantaged groups.
• Expansion of the creamy-layer principle.
• Minimum qualifying marks for admission to higher educational institutions.
• Greater benefits for the Economically Weaker Sections category.
• Repeal or amendment of the SC/ST (Prevention of Atrocities) Act.
• Withdrawal or review of the UGC’s 2026 equity regulations.

These should not automatically be presented as a unanimously approved charter. Some demands came from particular speakers or participating groups, and the campaign has not published one universally accepted document establishing which demands bind the entire movement.

What Happened at Jantar Mantar?

The protest was mobilised largely through social media. Hundreds of people gathered at Jantar Mantar on August 21 despite Delhi Police saying permission had not been granted for a demonstration at that venue.

Police had issued a no-objection certificate for a peaceful gathering of up to 500 people at Ramlila Ground until 4 pm. The permission did not cover a procession or an overnight stay.

Protesters nevertheless assembled at Jantar Mantar. More than 50 people were detained after some demonstrators remained at the site beyond the permitted period, according to reports. Police subsequently cleared the area. Delhi Police NOC report

The venue dispute became part of the movement’s political narrative, with protesters accusing the authorities of suppressing their demands and police maintaining that the Jantar Mantar gathering had not been authorised.

Is the Government Considering a Creamy Layer for SC/ST Reservation?

There is no such government decision. In fact, the Centre’s current position before the Supreme Court runs in the opposite direction.

In an affidavit filed in August 2026, the Union government opposed extending an income-based creamy-layer exclusion to Scheduled Caste and Scheduled Tribe reservation.

The government’s argument is that SC/ST reservation does not address poverty alone. It is intended to respond to historical discrimination, social exclusion, untouchability and inadequate representation.

The creamy-layer principle already applies to Other Backward Classes. Relatively advanced members of OBC communities are excluded from reservation benefits under defined criteria. But the Centre maintains that the same income-based test should not automatically be applied to SC and ST communities.

What Did the Supreme Court Say About ‘Quota Within Quota’?

In August 2024, a seven-judge Constitution Bench of the Supreme Court ruled by a 6:1 majority in State of Punjab v Davinder Singh that states may create sub-classifications within Scheduled Caste and Scheduled Tribe categories.

The objective is to ensure that reservation benefits reach communities that remain inadequately represented even within a reserved category.

However, a state cannot create such sub-quotas merely on the basis of political preference. It must rely on quantifiable evidence demonstrating relative disadvantage and inadequate representation.

Some judges also expressed support for identifying a creamy layer within SC/ST communities. But those observations did not automatically impose a nationwide income exclusion. A uniform policy would require defined criteria and further legal or governmental action. Supreme Court judgment

Can Reservation Be Based Only on Income?

India already has a separate reservation category based on economic disadvantage.

The 103rd Constitutional Amendment enabled up to 10% reservation for Economically Weaker Sections in education and public employment. In 2022, the Supreme Court upheld the amendment by a 3:2 majority.

However, EWS reservation did not replace the existing SC, ST and OBC quotas. It created an additional category for economically weaker people who are not covered by those reservations.

Replacing the entire caste-based system with an exclusively economic model cannot be done through a statement by one minister or an ordinary departmental order. It could require extensive constitutional, legislative and administrative changes, followed almost certainly by judicial scrutiny.

The SC/ST Act and Reservation Are Not the Same

Some speakers at the protest demanded repeal of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. But the Act and reservation operate in two separate legal fields.

Reservation concerns access and representation in education, public employment and elected institutions.

The SC/ST Act is a criminal law intended to prevent and punish caste-based violence, humiliation, dispossession, social exclusion and other specified atrocities.

Changing reservation policy would not automatically alter or repeal the Act. Any repeal or substantial amendment would require Parliament to pass legislation.

Claims of misuse must also be presented as allegations made by protesters unless supported by verified official data or judicial findings.

Why Is Nadda’s Meeting Politically Significant?

The importance of the meeting lies less in an immediate policy outcome and more in the signal it sends.

The BJP cannot easily dismiss discontent among unreserved communities and young aspirants who believe the existing system requires review. At the same time, SC, ST and OBC voters are central to the party’s national electoral coalition.

Any suggestion that caste-based safeguards might be abolished could provoke a major political response. Conversely, refusing even to discuss reform could alienate groups demanding economic criteria, sub-classification and stricter targeting of benefits.

Nadda appears to have opened a channel of communication without committing the government to either side.

What Does It Mean for Madhya Pradesh and Chhattisgarh?

The meeting does not change any reservation roster, recruitment rule or admission policy in Madhya Pradesh or Chhattisgarh.

Reservation frameworks are shaped by both central and state-specific laws, government orders and court decisions. The two states also have their own ongoing disputes over reservation percentages and recruitment rosters.

Unless the Centre or a state government issues a legally valid order, candidates should continue to follow the reservation rules mentioned in the relevant recruitment or admission notification.

What Happens Next?

Four developments will determine whether the meeting becomes a serious policy process or remains a political outreach exercise:

1. Whether Nadda holds the promised second meeting.
2. Whether the campaign produces a common written charter of demands.
3. Whether the different factions agree on recognised representatives.
4. Whether the Union government issues a formal statement on caste-based reservation.

Until then, claims that “reservation is ending” or that the government has approved an exclusively economic quota system would be misleading.
