'Bulldozer action means breaking the law’: CJI Gavai says, Govt cannot act like a judge

On Friday Chief Justice (CJI) BR Gavai said that the Indian judicial system operates on the rule of law, there is no place for bulldozer action in it. The CJI was speaking at the Sir Maurice Rault Memorial Lecture 2025 held in Mauritius.
The CJI said- The government cannot become judge, jury and executioner at the same time. Bulldozer rule violates Article 21 of the Constitution (right to protection of life and personal liberty).
Mauritius President Dharambir Gokhul, Prime Minister Navinchandra Ramgulam and Chief Justice Rehana Mangli Gulbul were also present during the lecture.
The CJI also mentioned decisions like abolishing triple talaq, repealing adultery law, electoral bond scheme and recognising privacy as a fundamental right.
Gavai said that all these decisions showed that the court made the rule of law a solid principle, which led to the elimination of arbitrary and unjust laws.
CJI Gavai said that the Rule of Law in India is not just a set of rules, but it is a moral and social framework that ensures equality, dignity and good governance.
Citing the contributions of Mahatma Gandhi and Dr Bhimrao Ambedkar, he said that their vision shows that in a democracy, the rule of law leads society towards justice and accountability.

On September 24, CJI Gavai had said that he felt extremely satisfied issuing orders against bulldozer action. This decision also had a humanitarian aspect.
A family cannot be harassed just because one member of that family is a criminal.
Gavai said- Justice KV Viswanathan was also with me on the bench. Although most of the credit has been given to me, I also want to say that Justice Viswanathan should also get credit for writing this judgment.
The Supreme Court delivered a judgment on bulldozer action in November 2024. The court said that officers cannot become judges. They should not decide who is guilty.
The bench had also said that if construction is demolished without 15 days notice, it will have to be rebuilt at the officer's expense. The court had also given 15 guidelines.
