Delhi Govt to Move SC Over Old Vehicle Rules

The Delhi government plans to approach the Supreme Court against the central rules banning old diesel and petrol vehicles. While the move raises hopes for vehicle owners, experts question whether stricter norms will truly offer relief.
The Delhi Government is planning to file a review petition in the Supreme Court against the stringent rules implemented on old vehicles. For this, the Transport and Environment Department has been directed to conduct a thorough study of the existing guidelines and enforcement rules related to old vehicles. Along with this, the impact of these rules, public opinion and their environmental aspects will also be evaluated.
Delhi Environment Minister Manjinder Singh Sirsa said that after the report is prepared, the government will review it, after which a final decision will be taken to file a petition in the Supreme Court. The Law, Transport and Environment departments are jointly examining the policy, legal provisions and practical aspects of the rules for old vehicles.
Old order of Supreme Court becomes a challenge
In 2018, the Supreme Court had directed that the operation of diesel vehicles older than 10 years and petrol vehicles older than 15 years be stopped in Delhi. Earlier, in 2014, the National Green Tribunal (NGT) had also banned parking of vehicles older than 15 years in public places.
Chief Minister Rekha Gupta recently announced that the Delhi government would request the Supreme Court to apply the same rules on old vehicles in the capital as are applicable in other states. This statement came in the context of the letter of Lieutenant Governor V.K. Saxena, in which he mentioned that removing 10-year-old diesel vehicles from the roads only in Delhi is against the principles of legal equality and justice.
Also requested the Air Quality Committee
The Delhi government has requested the Central Commission for Air Quality Management (CAQM) to immediately suspend the fuel ban applicable on old vehicles. Minister Sirsa said in a letter to the chairman of the commission that this ban is not practical and there are many technical challenges with it.
