Justice Nagarathna warns govt: SC Judge says public funds, court time are wasted; urges adoption of mediation for timely justice

Supreme Court Judge Justice BV Nagarathna has showed concern over government institutions pursuing lawsuits with little chance of success, warning that this wastes public funds and judicial time.

Her speech came to light on Tuesday, While participating in the National Arbitration Conference 2025 held in Bhubaneswar on September 27-28, which focused on "Strengthening the Arbitration Ecosystem in India."

Justice Nagarathna stressed that in cases involving minors, mediation should occur between the victim and the accused, conducted by trained trauma mediators.

She added- If government institutions continue to file such cases repeatedly, both the country’s money and court time will be spent in the wrong direction. Arbitration is a better alternative.

Justice Nagarathna urged lawyers to view themselves as 'solvers of human conflicts' and encouraged the adoption of mediation.

Mediation is not a weak form of justice but a timely, accessible, and equitable method. It is not just about obtaining a decision but about achieving justice- she said.
