SC Grants Relief to Prof. Ali Khan Mahmoodabad in Operation Sindoor Comment Case

One case against Prof. Ali Khan was closed, while the Supreme Court gave interim stay on action in another linked to his controversial remark on Operation Sindoor.
Ali Khan Mahmoodabad, who posted controversial social media posts on Operation Sindoor, has got relief in 1 out of 2 cases. The SIT has told the Supreme Court that it has filed a closure report in one case registered against the associate professor of Ashoka University. A chargesheet has been filed in the other.
After a brief hearing, the court ordered closure of one case. Regarding the second case, it was said that the lower court should keep its proceedings suspended for the time being. Senior advocate Kapil Sibal, appearing for Mahmoodabad, called both the cases similar and sought relief. He also objected to the fact that Section 152 (sedition) of the BNS has been imposed in the chargesheet. Sibal said that the issue of validity of this section is pending in the Supreme Court.
Haryana Police has registered two cases against Ashoka University Associate Professor Ali Khan Mahmoodabad. He was arrested on May 18 this year. On May 21, the Supreme Court granted him interim bail. In May, a bench headed by Justice Surya Kant handed over the investigation of the case to the SIT of 3 IPS officers of Haryana. On July 16, the court had asked the SIT to complete the investigation in 4 weeks.
Ali Khan Mahmoodabad is working as an associate at Ashoka University in Sonipat, Haryana. The university has given him the responsibility of the head of its political science department. 42-year-old Ali Khan made such a comment about the Indian Army's Operation Sindoor against Pakistan, which is absolutely not according to his position and status. He posted some posts on his social media on May 8. In these, he wrote that the flag bearers of Hindutva are having to praise Colonel Sophia Qureshi, who is a Muslim woman.
Ashoka University professor arrested
Haryana State Women Commission took suo motu cognizance of the professor's hate speech. The commission said that the professor had insulted a woman's dignity and tried to disturb communal harmony. The commission sent summons to Ali Khan. The next day, the police detained him on the complaint of Haryana BJP Yuva Morcha General Secretary Yogesh Jatheri. The police have registered a case against Ali Khan Mahmoodabad under sections of the Indian Penal Code (BNS) for inciting rebellion, disturbing communal harmony and hurting religious sentiments.
