BJP MLA Mishrilal Yadav's assembly membership has automatically ended as soon as he is sentenced to two years, but its formal announcement will be made only after the assembly receives a copy of the court order.
Notification of termination of his membership will be issued as soon as the copy is received. His constituency Alinagar will be declared vacant, as assembly elections are to be held in October-November, so there will be no by-election in Alinagar.
The period for termination of membership will remain 27 May only. He cannot even become a candidate in any election for the next six years. As a former MLA, he will continue to get pension and other due facilities.
Third MLA to lose membership in 5 years
Mishrilal Yadav will be the third MLA of the state to lose membership due to being sentenced to two years between 2020-25.
In 2022, the then RJD MLA of Mokama, Anant Singh's assembly membership was terminated due to being sentenced to 10 years.
In February last year, CPI-ML MLA Manoj Manzil of Agiaon in Bhojpur district also had to lose his assembly membership on the basis of punishment.
