MP Pramod Tiwari Opposes 130th Constitution Amendment Bill

Calling it an anti-democracy move, MP Pramod Tiwari strongly opposed the 130th Constitution Amendment Bill, terming it a “black law” and vowing not to let it become the law of India.
Congress MP Pramod Tiwari has reacted to the bill related to the removal of Prime Minister, Chief Ministers and Ministers trapped in serious criminal charges. He said that “Twice, due to their (BJP) misdeeds, the people of India brought them into minority. Their government could not be formed in many places. To bring back the majority, this black law is being brought. This is an anti-democracy law. We will not let this black law become the law of India.
Let us tell you that the Modi Government is going to make a law to remove the Prime Minister, Union Minister and Chief Minister or Minister from the post if they are arrested or detained in a serious criminal case. Union Home Minister Amit Shah introduced three bills in Parliament for this on Wednesday. The 130th Constitutional Amendment Bill was introduced in the Lok Sabha on Wednesday. This bill is a big step of the government towards preventing crime in politics. Its purpose is to remove the Prime Minister, Union Minister, Chief Minister and Ministers from their post if they are arrested or detained in serious criminal cases.
The objectives of the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025 state that such a law should also be made in the Constitution. There is no provision to remove a minister in case of arrest and detention on serious criminal charges. Therefore, there is a need to amend Articles 75, 164 and 239AA of the Constitution to make a provision for the removal of the Prime Minister or Union Minister, Chief Minister of states and Delhi or Minister. At the same time, under the new provisions, if any minister, including the Prime Minister, Chief Minister or Minister of states, is detained for 30 consecutive days for a crime punishable with a term of five years or more, then he can be removed from the post.
