Supreme Court Rebukes Rahul Gandhi Over China Remark: “No True Indian Will Say This”

The Supreme Court strongly reprimanded Rahul Gandhi for his statement on China occupying Indian land, questioning its basis and asserting that “no true Indian will say this without evidence.” The court advised caution in making such sensitive remarks.

Rahul Gandhi has got relief from the Supreme Court in the comment controversy case on the Indian Army. The apex court has stayed the action against Rahul. However, the Supreme Court has also reprimanded Rahul Gandhi by giving strict advice. On Monday, while hearing the case, the country's top court asked Rahul Gandhi - how did you know that China has grabbed India's land for 2000 kilometers? What reliable information do you have? A true Indian will not say this.

The Supreme Court reprimanded Rahul Gandhi and said that if you are the leader of the opposition, then why would you say these things? Why will you not ask these questions in Parliament? In response to this, senior advocate Abhishek Manu Singhvi, appearing for Rahul, said that he did not contest the election to get the freedom to speak in Parliament. Article 19 (1) (A) allows Rahul Gandhi to ask questions.

Singhvi said on behalf of Rahul that there is no need to file a defamation case against me. I have not been given any natural justice before cognizance was taken in the matter. Singhvi said that I understand the spirit in which this bench has asked the question, but there is a consensus that there is no natural justice or hearing here.

The Supreme Court said that why did you not say this in Parliament and why did you say it on social media? The Supreme Court said that if you are a true Hindustani then you should not say this? The Supreme Court said that even though you have freedom of expression, why did you say this. You are a responsible leader. Senior advocate Singhvi said that if he cannot say all this as the leader of the opposition, then what will be the result of this?

Justice Dutta said that how did you know when China occupied 2000 square kilometers? What is the reliable information? A true Indian will not say this. Can you say all this when there is a dispute across the border? Why can't you ask questions in Parliament?

In this case, the Supreme Court told Singhvi that you had taken a different line in the High Court. Singhvi said that one way is that you become the leader of the opposition and defame everyone, but it was not like that here. The Supreme Court issued a notice. A stay was imposed. Also, the court sought a reply in three weeks. In May, the Allahabad High Court rejected Gandhi's petition challenging the summons order passed by the MP-MLA court of Lucknow.
