HC Orders Compensation in 3-Year-Old Girl’s School Accident Case

The High Court has given its verdict on the death of a 3-year-old girl in a school accident, directing that compensation be provided to the grieving family.

The High Court has ordered the government to give a compensation of Rs 2 lakh to the family in the case of the death of 3-year-old Muskan in an accident in a school premises in Bilaspur. The hearing was held on Tuesday in the bench of High Court Chief Justice Ramesh Kumar Sinha and Justice Vibhu Dutt Guru.

Supporting the government in the hearing, Advocate General Prafulla N Bharat said that strict action has been taken in this case and an FIR has been registered against the accused DJ operator. At the same time, an amount of ₹ 50000 has been given to the family through the Indian Red Cross Society for this unfortunate incident. The collector has also issued guidelines to prevent such an incident from happening again. On which the Chief Justice's bench, in view of the seriousness of the incident, has ordered the government to give an additional ₹ 2 lakh to the family for this human loss. The matter has been relisted on 9 October 2025 for further monitoring.

Let us tell you that on the morning of August 14, three-year-old Muskan Mahilange was playing with children around the Anganwadi built in Talapara Ghoradana school premises. Then suddenly one of the iron pipes carelessly kept on the wall by DJ operator Rohit Devangan fell on her head. She was admitted to the hospital for treatment, where she died. Police have registered a crime against accused DJ operator Rohit Devangan and another under section 106, 3(5) of BNS. Rohit is the grandson of the school watchman and used to keep the goods inside the premises. Taking suo motu cognizance of this case, the court started hearing.

The court had sought a report from the collector as well as an affidavit from the government on providing assistance to the victim's family, which was presented on Tuesday. In the hearing held on Tuesday, the court has directed the state government to approve and distribute an additional compensation of Rs 2,00,000/- to the parents of the deceased child in addition to the amount already paid within one month from today. The District Magistrate, Bilaspur shall ensure that the additional amount of Rs. 2,00,000/- is disbursed to the parents of the deceased minor girl as ordered above and he shall also file an affidavit/compliance report before this Court in this regard.

Needless to state, the Court said that the Secretary, School Education Department, Government of Chhattisgarh and the Secretary, Women and Child Development Department shall be free to issue appropriate directions to all the District Officers to keep a strict vigil in and around the schools and Anganwadi premises so that no hazardous material or unauthorised items are stored in their premises which may pose a threat to the life of the staff or children working there.
