High Court Cracks Down on Illegal Excavation, Demands Affidavit from Mining Secretary

Taking a strict stance on illegal excavation on government land, the High Court has directed the Mining Secretary to submit a personal affidavit, indicating possible administrative negligence and lack of enforcement.

The High Court has sought a personal affidavit from the Mining Secretary in a case of illegal excavation. The case is of a PIL filed regarding illegal stone excavation on government land in village Nandeli of Sakti district. Hearing the petition, the division bench of Chief Justice Ramesh Sinha and Justice Vibhu Dutt Guru of the High Court has directed the Secretary of the Mining Department to file a personal affidavit. At the same time, the court has accepted the time sought by the Advocate General to file a reply.

The PIL has been filed by the petitioner Kholbahara through advocate Yogesh Chandra. In which it is said that illegal excavation of minor mineral stone has been going on for a long time by Rajeshwar Sahu and other private persons on government land of Khasra number 16/1, area 14.2 hectares located in village Nandeli, Tehsil Jaijaipur, District Sakti.

The villagers complained about this to the tehsil and district administration several times, but no concrete action was taken. Earlier, the petitioner had filed a separate writ petition, which was dismissed by the court in its order dated June 30, 2025, stating that the petitioner was not personally affected. However, the court had given him the liberty to file a PIL. After this, the present PIL was filed under Article 226 of the Constitution.
