The court said that there is a dispute regarding the relationship between the petitioner and the deceased employee. Settling this dispute is beyond the jurisdiction of the petition. The court has given permission to file a case in the civil court to settle the matter. The petitioner had made the Registrar General of the High Court the main party in his petition.
Ganesh Naidu, a resident of Bilaspur Yadunanand Nagar, was working as a peon in the High Court. He died during service on 16 June 2010. Wife Pooja Naidu was already working in the High Court. After the death of her husband, wife Pooja also died during service. After the death of the mother, daughter Richa Naidu was given compassionate appointment. Later she was removed from service.
Uslapur resident Neelkant Naidu applied for compassionate appointment on 9 February 2022, claiming himself to be the son and dependent of Ganesh Naidu. His application was rejected on 26 May 2022. After the application was rejected, Neelkant filed a petition in the High Court seeking compassionate appointment after his father's death.
Citing the document submitted by Naidu during the hearing of the case, the court said that the deceased employee had nominated wife Pooja Naidu and daughter Richa Naidu in his nomination form. The petitioner's name was not in the family list. Pooja Naidu had given an affidavit stating that she has only one daughter Richa from Ganesh Naidu. The rest of the children are of her husband's elder brother.
