Teacher Rationalization Dispute Reaches High Court Over Alleged Rule Violations

The issue of teacher rationalization has escalated to the High Court, with petitioners alleging serious violations in the counseling and transfer process. Accusations include disregard for established rules and lack of transparency. The court is set to examine whether the rights of teachers were compromised during the proceedings.

 
 

Bilaspur. The matter of rationalization being done by the School Education Department of the state finally reached the High Court sooner or later. 34 teachers including the state president of Chhattisgarh Vidyalaya Karamchari Sangh have challenged the rationalization citing violation of rules in counseling.

The order was issued on 2 August 2024 regarding the rationalization of schools and teachers in the state, then in view of the protest of teachers across the state, the government protested fiercely, after which the government did not implement it. A new order was again issued on 25 April 2025. In which many flaws are being counted.

State President of Chhattisgarh Vidyalaya Karamchari Sangh Sanjay Kumar Tiwari and 34 teachers of Patan Block and Durg said in the petition filed that under the new order, if the primary school is being merged with the middle school, then the head teacher of the primary will now become an assistant teacher. Similarly, in places where there is a middle school along with higher secondary, then after the merger, the head master will again become a teacher there. In this way the posts are being abolished.

It was told in the petition that in a case going on in the High Court, the government had said in the hearing that the post of Head Master is an administrative post, so he cannot be made a teacher.

The teachers said that under Article 309 of the Constitution, the Governor has made a provision for promotion in the Chhattisgarh School Education Service (Teacher and Administrative Cadre) Recruitment and Promotion Rules 2019. But counseling is being done without amending it. There is a provision to appeal in this, for which the opportunity is not being given. In this process, the Collector has been made the nodal officer, while he has no jurisdiction for the lecturer.
