High Court Allows Abortion for Minor Rape Survivor Over 28 Weeks Pregnant

The High Court has permitted a minor rape victim to undergo an abortion despite being over 28 weeks pregnant. The procedure will be conducted under special medical supervision to ensure the safety of the girl and adherence to legal and health protocols.

 
 

Madhya Pradesh High Court has given permission to a minor rape victim to have an abortion. The High Court has said that since the pregnancy of the minor is more than 28 weeks, the abortion should be done under special supervision of doctors. Actually, a minor resident of Damoh and her family had filed a petition in Damoh District and Sessions Court for permission for abortion, hearing which the District and Sessions Court sent a letter to the High Court. On which the High Court has given permission for abortion.

Abortion should be done under the supervision of a female specialist - High Court
The High Court has said that the abortion of the minor should be done under the supervision of a female specialist. It has also said that if the child is born alive, then the government will be responsible for its care. On the other hand, if the child turns out to be dead, then instructions have also been given to keep its fetus safe for DNA testing.
