MP High Court Issues Notice to BJP MLA Sanjay Pathak in Petition Filed by History-Sheeter Abdul Razzak

The Madhya Pradesh High Court on Monday issued a fresh notice to BJP MLA Sanjay Pathak, directing that it be served through the Assembly Secretary after earlier attempts to deliver it at his residence were unsuccessful. The notice was issued during the hearing of a petition filed by Jabalpur-based alleged history-sheeter Abdul Razzak, who is currently lodged in jail.

Razzak’s counsel informed the division bench of Justice Vivek Agrawal and Justice Ramkumar Chaubey that the previous notice sent to Pathak’s address could not be delivered as no one received it. The bench noted that a similar notice had earlier been issued on 31 October based on allegations made in the petition. The court fixed 15 December as the next date of hearing.

In his plea, Razzak has accused MLA Pathak of influencing the police machinery to initiate action against him due to commercial rivalry. He claimed the criminal cases registered against him were politically motivated and driven by the former minister’s alleged personal interests.

During an earlier hearing on 29 October, the court raised sharp questions to the police administration over the registration of multiple FIRs against Razzak despite him being in judicial custody since August 2021. The bench sought an explanation on how separate police stations continued to book a person already behind bars and why Pathak, against whom allegations were levelled, had not been made a party to the case.

Senior advocates Mohammad Ali, Shariq Aqeel Farooqui, and Amit Raizada, appearing for the petitioner, argued that Razzak was being subjected to continuous harassment under political pressure. They submitted that final reports in several pending cases had not been filed, and each time Razzak obtained bail in one case, police showed his arrest in another, calling it an abuse of the legal process.

The court has sought responses from all concerned parties before the next hearing.
