Rajasthan Politics: Rahul Gandhi lost his membership in 24 hours, why is Kanwarlal's membership still intact? - Congress raises questions, will go to Supreme Court
There was a new stir in Rajasthan politics when despite BJP MLA from Anta Kanwarlal Meena surrendering in the court after the Supreme Court's order, his assembly membership has not been canceled yet. Congress had already met the Speaker and the Governor regarding this matter, but now the party has announced to file a contempt petition in the Supreme Court regarding this.
Julie's question - How can there be two laws in one country?
Leader of Opposition Tikaram Julie raised the question that when Rahul Gandhi's membership of Parliament was terminated in just 24 hours, then why is Kanwarlal Meena's membership still intact even after 21 days? He said, is the BJP government above the Constitution? How can there be two laws in one country?
Julie also said that the Supreme Court's order is clear that the membership of a convicted MLA should be automatically terminated, yet the delay in decision by the Speaker of the Assembly is a blatant disregard of the judicial order. On this basis, the Congress will now file a contempt petition in the Supreme Court.
Conspiracy to hang and save the case
State Congress President Govind Singh Dotasara also launched a scathing attack and said that when the Supreme Court upheld the three-year sentence, then why has the assembly membership not been canceled till now? He alleged that the Speaker is deliberately hanging the case by making an excuse of the Advocate General (AG) report.
Dotasara said that the state is currently facing heat, water and electricity crisis, but no minister or officer of the government is seen on the spot. He taunted that the BJP government, which is doing politics on Congress in the SI recruitment case, has not been able to find any solution even in one and a half years.
What is the matter?
Kanwarlal Meena has been sentenced to three years in prison for pointing a pistol at an SDM and obstructing government work during the 2005 deputy sarpanch elections. He was first acquitted by the trial court, but in 2020 the ADJ court convicted him and this verdict was upheld by both the High Court and the Supreme Court in 2025.
According to Article 191(1)(e) of the Constitution and Section 8 of the Representation of the People Act, the membership of a public representative sentenced to two years or more is automatically terminated.
