High Court questions contract appointments at state mental hospital, seeks timeline for regular recruitment

The Chhattisgarh High Court has expressed strong displeasure over the state government’s continued reliance on contractual appointments at the state’s only mental hospital and the absence of a clear timeline for regular recruitment. Hearing a public interest litigation on alleged mismanagement at the mental hospital in Sakri, Bilaspur, the court directed the Health and Family Welfare Secretary to file a fresh affidavit by March 24 detailing when permanent appointments would be completed.

A division bench comprising Chief Justice Ramesh Sinha and Justice Ravindra Kumar Agrawal said the focus must be on a permanent solution rather than interim arrangements. The bench noted that despite repeated directions, the government failed to clearly state timelines for regular recruitment of psychiatrists and other key staff.

The matter pertains to a PIL highlighting staff shortages, sanitation issues and inadequate patient facilities at the Sakri mental hospital. During earlier hearings, the court had appointed advocate Rishi Rahul Soni as court commissioner to inspect the hospital and submit a report on patient care and infrastructure. His findings flagged shortages of specialist doctors and support staff, along with concerns over cleanliness and overall management.

In response, the state government informed the court that to prevent disruption of mental health services, two MD (Psychiatry) doctors were appointed on contract for two years under an order dated January 2, 2026. Both doctors joined duty on January 13, 2026 and are currently providing services at the State Mental Hospital, Sendri.

The affidavit further stated that recruitment of a pathology specialist has been completed and a selection list issued. The process for appointing a clinical psychologist and counsellor (social worker) is underway through the Public Service Commission. Recruitment of ward boys and ward attendants has been completed by the professional examination board, with appointment orders to be issued after document verification.

However, the court remained unconvinced. The amicus curiae pointed out that the affidavit did not specify key details related to fresh recruitment of psychiatrists, including the proposed schedule, stages of selection, interview timelines, practical hurdles and measures to resolve them.

The government also disclosed that an advertisement for psychiatrist recruitment was issued through the Chhattisgarh Public Service Commission on April 22, 2025. During document verification, all applicants were either absent or found ineligible, resulting in no candidates being shortlisted for interviews and the recruitment process being stalled.

Taking note of the situation, the High Court reiterated the need for systemic reforms and directed the health secretary to submit a detailed affidavit explaining the future course of action and a definitive timeline for regular recruitment. The matter will be reviewed in the next hearing.
