 'Accusing Husband of Impotence Without Proof Is Mental Cruelty': Chhattisgarh HC Justifies Divorce, Cancels Family Court Order

The Chhattisgarh High Court ruled that making baseless accusations of impotence against a husband amounts to mental cruelty. The court set aside the family court's order and upheld the husband's plea for divorce.

The Chhattisgarh High Court, while giving its verdict in an important case related to divorce, has said that if the wife makes a serious allegation like impotence on her husband without any medical proof, then it comes under the category of mental cruelty. The court has considered it as the basis for a valid divorce.

Let us tell you that this case is related to a man from Janjgir-Champa district, who was married to a woman resident of Ramanujganj in Balrampur district on 2 June 2013. The husband was working as an education worker in Charcha Colliery of Baikunthpur, while the wife is an Anganwadi worker. Shortly after the marriage, the wife started pressuring the husband to leave the job or get a transfer. The relationship between the two had completely broken down since the year 2017 and they started living separately.

After about seven years, in 2022, the husband filed a divorce petition in the family court. During the hearing, the wife accused the husband of being incapable of having sex, but she also admitted that she had no medical evidence of this allegation. On the contrary, the husband alleged that the wife falsely accused him of having an illicit relationship with a woman from the neighbourhood, which damaged his social image.

The husband also said that when a meeting was held at the social level to improve relations, the wife quarreled there too and misbehaved with her own brother-in-law. The High Court also put this behavior in the category of mental cruelty.

After a full hearing of the case, the High Court ruled that making a serious allegation like impotence without proof not only hurts the reputation of the person, but it also has a serious impact on his mental health. The court said that maintaining the marriage in such circumstances would not be in accordance with justice and law.
