Representations Submitted Regarding MCD’s MLFF Toll Tender; Matter Pending Before Delhi High Court

New Delhi: Two infrastructure companies have submitted representations to the Hon’ble Chief Minister of Delhi regarding the Municipal Corporation of Delhi’s (MCD) tender for the implementation of a Multi-Lane Free Flow (MLFF) toll collection system at 154 border entry points.
The representations have been submitted by M/s Skylark Infra Engineering Pvt. Ltd. and M/s Sri Sai Enterprises & Developers Pvt. Ltd., who have requested that the bidding process be examined before the tender is finalized.
According to the representations, the companies submitted a financial bid of ₹1,057.77 crore, while the highest bid presently under consideration is ₹963.99 crore. The companies have stated that, in their assessment, a different bidding outcome could have resulted in higher revenue for the Municipal Corporation over the tenure of the contract.
The companies have also stated that certain eligibility conditions in the tender resulted in three bidders qualifying at the technical evaluation stage. They have further submitted that a similar eligibility condition had reportedly been removed in an earlier tender and has now been included in the present tender. These submissions form part of the representations made by the companies.
The matter is presently pending before the Hon’ble Delhi High Court in W.P.(C) No. 8368/2026. Arguments have concluded, and judgment has been reserved. The petitioners have requested that no Letter of Award be issued until the Court pronounces its decision.
In their representations, the companies have also requested that the matter be examined by the appropriate authorities, including the Vigilance Department and the Central Vigilance Commission (CVC). They have further requested that, if any issues are identified during such examination, appropriate action be taken in accordance with law.
