Sulthan Bathery Munsiff Court Grants Interim Injunction to Protect Family from Alleged Trespass and Criminal Intimidation

Court restrains Karnataka resident from entering family's property after alleged threats linked to business rivalry.

The Munsiff Court in Sulthan Bathery , Wayanad has granted an interim injunction restraining a Karnataka resident from entering the residence of a local family following allegations of criminal trespass, intimidation and threats arising from an alleged business dispute.

The order was passed in favour of Shymol Jose, a resident of Manichera, Poomala, who approached the court seeking protection for her family, including an Six-month-old infant. According to the petition, the dispute is linked to alleged financial and business transactions involving her son-in-law, Dr. Bhargav Mallappa.

The petition states that on June 20, 2026, at around 8:10 a.m., the respondent, Mylaraswamy of Chitradurga, Karnataka, along with B.P. Suresh and two unidentified persons, allegedly trespassed into the property, banged on the front door and attempted to force entry into the house. When family members intervened, they were allegedly threatened with dire consequences before police arrived and removed the group from the premises.

The family also alleged continuous intimidation and attempts to unlawfully access the mobile phone of Jose's son-in-law. Complaints regarding the incidents have been submitted to the Sulthan Bathery Police Station.

After considering the material before it, the court found a prima facie case and held that the balance of convenience favoured protecting the family. It accordingly restrained Mylaraswamy, his associates and agents from entering the property or disturbing the family's peaceful possession until further orders.
