Ukraine Weighs Porn Legalisation to Raise War Funds, Aid Drones

Ukraine is considering legalising and taxing its adult-content industry as Kyiv searches for additional domestic revenue to support its war effort against Russia. A proposed law would remove criminal penalties for the production and distribution of pornography involving consenting adults while keeping protections against child sexual exploitation.

The proposal, co-authored by lawmaker Yaroslav Zhelezniak, has already passed its first reading in Ukraine's parliament and is awaiting further consideration. Zhelezniak estimates that bringing the industry into the formal tax system could generate about $25 million annually, enough, by his calculation, to finance roughly 30,000 military drones.

The proposed revenue would be modest compared with Ukraine's overall wartime defence requirements, but supporters argue that even a relatively small domestic revenue stream could provide additional flexibility for military spending.

Pornography Ban Faces Challenge

Ukraine's existing legal framework has created what lawmakers describe as a contradiction. Adult pornography remains subject to criminal restrictions, while Ukrainian tax authorities can require people earning income from overseas platforms to declare that income and pay taxes.

That leaves some creators in a difficult position: declaring earnings can make their activity more visible to authorities even though the underlying production or distribution of adult content remains criminalised.

The proposed legislation seeks to resolve that conflict by removing criminal liability for adult pornography while retaining criminal penalties related to minors and sexual exploitation.

OnlyFans Reveals Industry Scale

The size of Ukraine's online adult-content economy has become increasingly difficult for authorities to ignore.

Data from Fenix International, the UK-based parent company of OnlyFans, showed that about 7,900 Ukrainian creators earned more than $131 million through the platform in 2023.

Supporters of legalisation argue that taxing a sector already generating significant income could provide the government with additional revenue while giving creators a clearer legal framework in which to operate.

Extortion Claims Add Pressure

Lawmakers and industry representatives have also linked the proposed reform to allegations of corruption and police extortion.

Critics of the current system say the criminal status of adult content gives corrupt officials leverage over creators and webcam studios. Ukrainian prosecutors have reportedly investigated allegations that police officials in several regions demanded regular payments from studios in exchange for avoiding enforcement action.

Legalisation supporters argue that removing the criminal basis for adult-content production could reduce opportunities for such abuses and allow legitimate businesses to operate under ordinary tax and regulatory rules.

Drones Become Funding Symbol

The proposed $25 million annual tax take is being presented partly through its potential military impact.

Zhelezniak has estimated that the money could finance around 30,000 drones, highlighting the importance of relatively small but rapidly deployable weapons systems in Ukraine's war strategy.

Ukraine has increasingly relied on drones for reconnaissance, battlefield strikes and defence against Russian attacks. Kyiv has also been expanding domestic drone production and pursuing international partnerships to increase supplies.

Against that backdrop, supporters say additional tax revenue—even if small compared with total defence spending—could be directed toward equipment that can be procured relatively quickly.

Bill Still Faces Debate

The proposal remains politically controversial and is not yet law.

Ukraine's parliament has previously considered attempts to decriminalise adult pornography. An earlier bill, No. 12191, was rejected in May after receiving 207 votes, short of the 226 needed for approval.

The current proposal has advanced further, having cleared its first parliamentary reading. However, it still needs to complete the remaining legislative process before any changes take effect.

Lawmakers are also expected to debate how the proposed system would regulate adult-content businesses, taxation, online platforms and safeguards against exploitation.

Child Protection Remains Separate

Supporters of decriminalisation have stressed that legalising adult pornography would not mean removing criminal penalties for child sexual abuse material.

Ukraine's parliament separately advanced legislation in July aimed at strengthening penalties related to child pornography and sexual exploitation. The measure passed its first reading with 231 votes.

That distinction is central to the current debate: the proposed reform concerns consensual adult content, while material involving children would remain strictly criminalised.

War Economy Drives Reform

The debate comes as Ukraine faces enormous financial demands from its prolonged war with Russia.

The country's parliament recently rejected another tax measure linked to international financing, highlighting the difficulties Kyiv faces in raising additional revenue while protecting households from higher costs. Reuters reported that Ukraine faces a substantial defence funding gap and is seeking billions of dollars in international financial support.

Against that backdrop, legalising and taxing an already existing online industry is being presented by supporters as a way to capture revenue that currently sits largely outside the formal economy.

Whether the proposal ultimately becomes law will depend on further parliamentary votes and negotiations. For now, the debate illustrates the extraordinary measures Ukraine is considering as it searches for new sources of money to sustain its wartime economy and defence effort.
