Delhi HC Upholds Call Interception to Curb Corruption

In a significant ruling, the Delhi High Court declared that call interception is legal if used to prevent large-scale corruption, reinforcing its role in safeguarding public interest.

The Delhi High Court recently decided that interception of phone calls is legal to deal with large-scale corruption. Justice Amit Mahajan clarified that corruption cases do not always have the potential to impact the public, but when large amounts of money are involved, it meets the conditions of 'public safety' required to intercept calls under the Indian Telegraph Act, 1885.

The court has made it clear that it cannot be generalized that all cases related to corruption have the potential to have a wide impact on the public. The allegations in this particular case are not related to any trivial project.

The court said that this is a project worth Rs 2149.93 crore, and the impact of the work demanded in it will also be quite large. According to the court, the economic scale of this crime meets the criteria of public safety.

The Delhi High Court made important remarks on June 26 while hearing the petition of Akash Deep Chauhan. In this petition, Akash Deep Chauhan was accused of criminal conspiracy and under the Prevention of Corruption Act. According to the allegations, Akash, along with a company, tried to get a sub-contract from Shapoorji Pallonji, a major construction company.

CBI intercepted calls

Shapoorji Pallonji was entrusted with the task of redevelopment of the Integrated Exhibition-cum-Convention Center at Pragati Maidan in Delhi. The CBI intercepted several calls between the accused, which confirmed the conspiracy. After hearing the case, the court dismissed the petition of Akash Deep Chauhan, upholding the trial court's order.
